Silentias Terms of Service

Welcome to Silentias. These Terms of Service ("Terms") govern your access to and use of silentias.com (the "Site") and your purchase of products from Silentias LLC ("Silentias," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. Please read them carefully.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from us or use the Site.

2. Products and pricing

We try to describe and display our products as accurately as possible. Colors and details may vary slightly due to screens and photography. Prices are shown in U.S. dollars and may change at any time. We may correct errors, limit quantities, or refuse or cancel any order at our discretion, including after an order has been placed.

3. Orders and acceptance

Your order is an offer to buy. We accept your order when we send a confirmation or ship your products. We may decline or cancel an order for reasons including product availability, errors in pricing or description, or suspected fraud.

4. Subscriptions and automatic renewal

Some products are offered on a subscription basis. By starting a subscription, you authorize us to charge your payment method on a recurring basis, for example monthly, until you cancel.

  • Your subscription renews automatically at the then-current interval and price for your plan, unless you cancel before the next billing date.
  • You may cancel at any time through your account or by contacting support@silentias.com. Cancellation takes effect at the end of your current billing period, and you will not be charged for the following period.
  • Founding Member pricing, where offered, applies only while your subscription remains active and continuous. If you cancel, you may lose that pricing, and any future subscription will be at the then-current standard price.
  • Refunds for subscription orders follow our Returns Policy in Section 7.

We will disclose the key terms of any subscription, including price and billing frequency, before you enroll.

5. Payment

You agree to provide a valid payment method and authorize us and our payment processor to charge it for your orders, including recurring subscription charges. You are responsible for keeping your payment information current.

Silentias reserves the right to dispute fraudulent chargebacks and may submit order records, delivery confirmation, account history, IP address information, and customer communications to payment processors and financial institutions.

6. Shipping, delivery, and international orders

Shipping timeframes are estimates and are not guaranteed. Risk of loss passes to you when the carrier receives the order. For international orders, you are responsible for any customs duties, taxes, or fees imposed by your country, and for ensuring the products may lawfully be imported into your location.

7. Returns and refunds (The Silentias Promise)

  • Sealed and unopened items: You may request a full refund within 14 days of delivery. You are responsible for return shipping.
  • Opened or used items: Opened or used sleep strips are final sale. For health and hygiene reasons, opened products cannot be returned.
  • Defective or damaged in transit: We will replace the item at no cost and do not require a return. Please send a photo within 72 hours of delivery.
  • Wrong or incorrect order that is our error: We will provide a full refund or a replacement.

8. Product use and disclaimers

Silentias products are intended as comfort and wellness products for general use. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and they are not a substitute for professional medical advice. If you have a medical condition or concern, please consult a qualified healthcare provider before use. You use our products at your own discretion and risk.

Individual results may vary. Silentias makes no guarantee regarding any specific outcome from use of its products.

Except as expressly stated, the Site and products are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

9. Intellectual property

The Site and all of its content, including the Silentias name, logo, text, images, and design, are owned by or licensed to Silentias LLC and are protected by law. We grant you a limited, personal, non-transferable license to use the Site for its intended purpose. You may not copy, reproduce, or use our content or brand without our written permission.

10. Acceptable use

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, infringing the rights of others, or using it for any unlawful purpose.

11. Limitation of liability

To the fullest extent permitted by law, Silentias LLC and its owners and team will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product that gave rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Silentias LLC from any claims, losses, or expenses arising from your misuse of the Site or your violation of these Terms.

13. Force majeure

Silentias shall not be liable for delays or failures caused by events beyond our reasonable control, including natural disasters, carrier disruptions, labor disputes, government actions, pandemics, customs delays, internet outages, or acts of God.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction, unless applicable law in your place of residence provides otherwise. Nothing in these Terms removes or limits any mandatory consumer protection rights you may have under the laws of your country of residence, including in the European Union, the United Kingdom, Switzerland, Canada, Australia, and New Zealand.

15. Changes to these Terms

We may update these Terms from time to time. The "Effective date" above shows when they were last revised. Your continued use of the Site after changes means you accept the updated Terms.

16. Severability and entire agreement

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Silentias regarding the Site and your purchases.
